TERMS OF SERVICE

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THIS WEBSITE OR PLACING AN ORDER. BY ACCESSING BLOOMINGZONE.FARM OR COMPLETING A PURCHASE, YOU AGREE TO BE BOUND BY THESE TERMS OF SERVICE.

1. About BloomingZone.farm

BloomingZone.farm (“BloomingZone,” “we,” “our,” or “us”) is a vertically integrated plant nursery and e-commerce business. We grow, cultivate, package, and ship live plants directly to customers across the United States through our online store at bloomingzone.farm, which is operated on the Shopify platform. These Terms of Service (“Terms”) govern your access to and use of our website, products, and services. By browsing our website, creating an account, or placing an order, you (“Customer,” “you,” or “your”) agree to these Terms in full.

2. Eligibility & Account Registration

You must be at least 18 years of age to place an order or create an account on BloomingZone.farm. By using our website, you represent and warrant that you meet this requirement. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at support@bloomingzone.farm if you suspect any unauthorized access to your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

3. Products — Live Plants

3.1 Nature of Our Products

  • Live plants are perishable and require proper care upon receipt
  • Plant size, appearance, and maturity may vary from photos
  • Seasonal availability may affect whether specific plants are in stock
  • Some plants may be dormant, bare-root, or in early growth stages depending on the season at time of shipment
  • Natural blemishes, minor leaf damage, or stress from shipping does not constitute a defect

3.2 Plant Descriptions & Accuracy

We make every effort to accurately describe our plants, including species, care requirements, mature size, and growing conditions. However, we do not warrant that product descriptions, pricing, or other content on our website is completely free of errors. We reserve the right to correct errors and update product information at any time without prior notice.

3.3 Plant Health Guarantee

We take pride in the quality of every plant we grow and ship. All plants are inspected before packaging. If your plant arrives in a condition that is clearly dead on arrival (DOA) or severely damaged due to our packaging or handling, please see Section 8 (Refunds, Returns & Replacements) for the steps to resolve your claim.

4. Pricing & Payment

4.1 Pricing

All prices listed on bloomingzone.farm are in U.S. dollars and are subject to change without notice. Prices do not include applicable taxes or shipping fees, which will be calculated and displayed at checkout before you complete your purchase.

4.2 Payment

We accept all major credit cards, debit cards, and other payment methods made available through our Shopify checkout. By submitting payment, you represent that you are authorized to use the payment method provided and that the billing information you submit is accurate and complete. All transactions are processed through Shopify Payments or another PCI-DSS compliant payment processor. BloomingZone.farm does not store your full credit card number or sensitive payment data on our servers.

4.3 Order Confirmation

Placement of an order constitutes an offer to purchase. We reserve the right to accept or decline any order at our discretion. An order is not confirmed until you receive an order confirmation email. We may cancel an order if a product is out of stock, a pricing error occurred, or we are unable to verify payment.

4.4 Sales Tax

Sales tax will be collected where required by applicable state and local laws based on your shipping address. Tax amounts are displayed at checkout.

5. Shipping & Delivery

5.1 Shipping Areas

We currently ship live plants to addresses within the contiguous United States (the lower 48 states). We do not ship to Alaska, Hawaii, U.S. territories, or international addresses at this time, unless otherwise stated on our website. It is your responsibility to verify that the plants you are ordering are legal to receive in your state. Some plants may be restricted or prohibited in certain states due to agricultural regulations. BloomingZone.farm is not responsible for orders refused or seized by state agricultural authorities. No refunds will be issued for orders confiscated due to state import restrictions that are the customer’s responsibility to verify.

5.2 Shipping Timelines

We ship plants Monday through Wednesday to reduce the risk of packages sitting in carrier facilities over the weekend. Estimated delivery timelines vary by destination and shipping method selected at checkout. All estimated delivery dates are approximations only and are not guaranteed. Factors that may affect delivery timing include:

  • Carrier delays (USPS, UPS, FedEx, or other designated carriers)
  • Extreme weather events or natural disasters
  • Holidays or high-volume shipping periods
  • Incorrect or incomplete shipping addresses provided at checkout

BloomingZone.farm is not responsible for carrier delays once a package has been handed to the shipping carrier. Tracking information will be provided via email when your order ships.

5.3 Packaging

We carefully package all live plants to minimize transit stress. Our packaging is designed to protect plants during shipment; however, some degree of transit stress (such as minor wilting or leaf drop) is normal and expected. Plants should recover with proper watering and care after arrival. This does not constitute damage or entitle the customer to a refund.

5.4 Failed Deliveries & Undeliverable Packages

If a package is returned to us as undeliverable due to an incorrect address provided by the customer, refusal of delivery, or failed delivery attempts, the customer is responsible for any re-shipping fees. BloomingZone.farm is not responsible for the condition of plants in packages that are returned due to customer error or refusal.

5.5 Risk of Loss

Title and risk of loss for all products pass to you upon delivery to the shipping carrier. BloomingZone.farm is not responsible for lost, stolen, or damaged packages after the carrier takes possession. If your package is lost or shows as delivered but was not received, please contact the carrier directly and then reach out to us at support@bloomingzone.farm and we will do our best to assist.

6. Weather & Extreme Temperature Policy

Live plants are sensitive to extreme heat and cold. While we make every effort to ship plants under favorable conditions and use appropriate packaging, we cannot control weather conditions during transit. By placing an order, you acknowledge the following:

  • BloomingZone.farm is not responsible for plant damage caused by extreme temperatures during transit that are beyond our control
  • We strongly recommend monitoring weather conditions at your delivery address before placing an order during extreme heat or cold periods
  • Heat packs and insulated packaging may be available as add-ons during cold months — it is the customer’s responsibility to select these options if needed
  • We may delay shipment at our discretion if we believe weather conditions present an unacceptable risk to plant survival

If we delay your shipment due to weather concerns, we will notify you by email. No additional charges will be applied for weather-related shipping delays initiated by us.

7. Order Cancellations & Modifications

Orders may be cancelled or modified only before they have been processed for fulfillment. Once an order has been packed and handed to the shipping carrier, it cannot be cancelled or modified. To request a cancellation or modification, contact us immediately at support@bloomingzone.farm with your order number. We will make every effort to accommodate your request but cannot guarantee changes once order processing has begun. If we are unable to cancel your order before shipment, standard return and refund policies will apply.

8. Refunds, Returns & Replacements

8.1 Live Plant Policy

Because our products are live plants — a perishable, time-sensitive category — we do not accept returns of live plant material. All sales are final once a plant has been shipped, subject to the exceptions below.

8.2 Dead on Arrival (DOA) Claims

If your plant arrives clearly dead on arrival (DOA) — meaning the plant shows no signs of life and cannot reasonably be expected to recover with standard care — you may submit a claim within 72 hours of the confirmed delivery date. To submit a DOA claim, you must:

  • Contact us at support@bloomingzone.farm within 72 hours of confirmed delivery
  • Include your order number in the subject line
  • Provide clear photos of the plant as received, including the packaging and shipping label
  • Describe the condition of the plant in detail

Claims submitted after 72 hours of confirmed delivery will not be accepted. We reserve the right to request additional information or photos before issuing a remedy.

8.3 Approved Remedies

Upon review and approval of a valid DOA claim, we will offer, at our discretion:

  • A replacement plant of the same or equivalent variety (subject to availability)
  • A store credit for the value of the affected plant
  • A partial or full refund in exceptional circumstances

We will not issue refunds or replacements for:

  • Normal transit stress such as minor wilting, leaf drop, or yellowing that resolves with proper care
  • Damage resulting from customer neglect, improper care, or failure to follow care instructions after delivery
  • Damage caused by extreme weather during transit when weather-related packaging add-ons were available and not selected
  • Plants that die after successful delivery and proper acceptance by the customer
  • Claims submitted more than 72 hours after confirmed delivery

8.4 Non-Plant Products

For non-plant items such as pots, soil, accessories, or merchandise, standard return and refund procedures apply. Items must be returned unused and in original condition within 14 days of delivery. Return shipping costs are the responsibility of the customer unless the item arrived defective.

9. Intellectual Property

All content on bloomingzone.farm, including but not limited to photography, plant descriptions, logos, graphics, videos, written content, and website design, is the exclusive property of BloomingZone.farm or its content licensors and is protected by applicable copyright, trademark, and intellectual property laws. You may not reproduce, copy, republish, upload, post, transmit, distribute, or modify any content from our website without our prior written consent. Limited personal, non-commercial use is permitted solely for the purpose of browsing and shopping on our website.

10. Prohibited Uses

You agree not to use bloomingzone.farm for any of the following purposes:

  • Violating any applicable law, regulation, or third-party rights
  • Submitting false, fraudulent, or misleading orders or information
  • Scraping, crawling, or harvesting data from our website using automated tools
  • Attempting to gain unauthorized access to our systems, accounts, or data
  • Interfering with the functionality or security of our website
  • Reselling our products in violation of any applicable law or our stated policies
  • Using our website to transmit spam, malware, or other harmful content

We reserve the right to terminate your account and refuse service to anyone who violates these Terms or engages in conduct we deem harmful to our business, customers, or community.

11. Third-Party Services — Shopify

Our online store is hosted and operated through Shopify Inc. By using our website and placing orders, you are also subject to Shopify’s Terms of Service and Privacy Policy, available at shopify.com. BloomingZone.farm is not responsible for Shopify’s platform policies, outages, or changes to their services. Payment processing, checkout, and certain customer account features are managed through Shopify’s infrastructure. We are not responsible for errors, delays, or service interruptions originating from Shopify’s platform.

12. Disclaimer of Warranties

THE WEBSITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. BloomingZone.farm does not warrant that: (a) our website will be uninterrupted, error-free, or free of viruses or other harmful components; (b) product descriptions or other content are accurate, complete, or current; or (c) any specific plant will survive in your particular climate, soil, or growing conditions. Plants are living organisms. Their survival and performance after delivery depends on numerous factors outside our control, including local climate, soil conditions, sunlight, water, and the customer’s care practices. We do not guarantee that any plant will thrive, flower, fruit, or reach a specific size after delivery.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BLOOMINGZONE.FARM, ITS OWNERS, EMPLOYEES, AGENTS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OUR WEBSITE OR PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR YOUR PURCHASE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE ORDER GIVING RISE TO THAT CLAIM. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless BloomingZone.farm and its owners, officers, employees, agents, and suppliers from and against any claims, liabilities, damages, judgments, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of our website or products; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any content you submit to us.

15. Governing Law & Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. You consent to the exclusive jurisdiction of the state and federal courts located in Florida for any disputes arising from these Terms or your use of our website.

15.2 Informal Resolution

Before filing any formal legal claim, you agree to contact us at legal@bloomingzone.farm and give us 30 days to attempt to resolve the dispute informally. Most disputes can be resolved quickly through direct communication.

15.3 Class Action Waiver

To the fullest extent permitted by law, you waive any right to bring claims against BloomingZone.farm as a plaintiff or class member in any class action, collective action, or representative proceeding.

16. Privacy Policy

Your use of bloomingzone.farm is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy describes how we collect, use, and protect your personal information, including our practices related to email and SMS communications. 17. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we do, we will update the “Last Updated” date at the top of this page. For material changes, we may also notify registered customers by email. Your continued use of our website or placement of an order after any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically. We encourage you to check this page before placing each order.

18. Severability & Entire Agreement

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity or enforceability of the remaining provisions. These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and BloomingZone.farm with respect to your use of our website and purchase of our products, and supersede all prior agreements, representations, or understandings.
